Withdrawal of consent does not affect the lawfulness of the processing carried out before its withdrawal

 

INFORMATION ON THE PROCESSING OF JOB CANDIDATES' DATA (“CANDIDATES”)

1. The controller of your personal data is Industrial and Commercial Bank of China (Europe) S.A. Poland Branch, located at pl. Trzech Krzyży 18, Warsaw (hereinafter referred to as the "Controller").

2. You can contact the Controller via email at info@pl.icbc.com.cn, by phone at +48 22 278 8015, or in writing at Warsaw 00-499, pl. Trzech Krzyży 18.

3. A data protection officer has been appointed at the Controller, who can be contacted via email at iod@pl.icbc.com.cn, or in writing at the Controller’s registered office with the note "to the data protection officer."

4. Your personal data will be processed:

a. If you prefer employment under a contract of employment - to fulfill obligations arising from legal regulations related to the recruitment process, primarily the Labor Code – the legal basis for processing is the legal obligation of the Controller (Article 6(1)(c) of the General Data Protection Regulation No. 2016/679 (GDPR) in connection with the provisions of the Labor Code); for conducting the recruitment process regarding data not required by law – the legal basis for processing is consent (Article 6(1)(a) GDPR);

b. If you prefer employment under a civil contract – the legal basis for processing data contained in application documents is the legitimate interest of the Controller (Article 6(1)(f) GDPR). The legitimate interest is conducting the recruitment process and selecting a person to conclude a cooperation agreement;

c. To verify your qualifications and skills and establish cooperation terms – the legal basis for data processing is the legitimate interest of the Controller (Article 6(1)(f) GDPR). The legitimate interest of the Controller is to verify job candidates and specify the conditions for potential cooperation with you;

d. To establish or pursue potential claims or defend against such claims by the Controller – the legal basis for data processing is the legitimate interest of the Controller (Article 6(1)(f) GDPR).

5. Your personal data may be shared with entities providing services to the Controller related to recruitment processes, such as recruitment agencies, and with suppliers of IT systems and services.

6. Your personal data may be transferred to third countries outside the European Economic Area for internal administrative purposes of the capital group to which the Controller belongs. The Controller will transfer data subject to appropriate safeguards, including in particular standard contractual clauses.

7. Personal data will be processed for the period necessary to conduct the recruitment process, but no longer than for 1 year from their receipt, and insofar as processing is based on consent – until it is withdrawn. The processing period may be extended each time by the limitation period for claims, if processing your personal data is necessary to establish or pursue potential claims or defend against such claims by the Controller. After this period, the data will be processed only to the extent and for the time required by law.

8. Consent given can be withdrawn at any time. The withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal. For evidential purposes, the Controller requests that consent be withdrawn in writing to the registered office or electronically.

9. You have the following rights: the right to request access to personal data, their rectification, deletion, or restriction of processing, the right to object to the processing of your personal data and to their transfer, and the right to file a complaint with the President of the Personal Data Protection Office.

10. The right to object to the processing of personal data applies when:

a. the processing of personal data is based on legitimate interests or for statistical purposes, and the objection is justified by a particular situation in which the person whose data are processed finds themselves, or

b. personal data are processed for direct marketing purposes, including profiling, to the extent that the processing is related to such direct marketing.

11. Providing personal data is required by the Controller for recruitment purposes. The consequence of not providing this data is the inability to consider your application in the recruitment process.

12. If you do not want the Controller to process your additional personal data, please refrain from including such personal data in the recruitment documents submitted.
